Zebric is owned and operated by DataHouse Inc., a Delaware corporation (“we,” “our”) with offices in Honolulu, Hawaii.

The Zebric Application (the “Service”) is a portfolio platform intended for use by teachers, students, and administrators (“you,” “your”), within an educational setting and for educational purposes.

1) Changes

In order to remain current with applicable laws and regulations, we may make changes to this Privacy Policy at any time.  If we do, we will notify you via the Service, by email, by means of a notice upon logging in to the Service, or by means of a notice on our homepage of the Service. To make our Privacy Policy easily accessible, we have included it at the Apple app store as well as the Android Play Store.

2) The Information We Collect

This Privacy Policy applies to all information collected via the Service plus any information you provide to us by email, by telephone, or in writing.

You provide Personal Information to us when you register to use the Service. The Personal Information we collect from you includes, but is not limited to the following:

Your name (teacher and/or school administrator)
Email Address
Class Name (a “class” is a group of users defined by you)

You can also create members of a class or grant user access to the Service by issuing accounts to additional users.
We store all Personal Information that you submit for registration purposes, and all text and media (images, video, embedded content) posted via the Service. If you submit additional information to us regarding the functionality of the Service or any problems you encounter, we may use this information to improve the performance of the Service or provide customer service to you and others. We only retain student information to support educational/school purposes in accordance with the Family Educational Rights and Privacy Act of 1974 (34 CFR Part 99) (“FERPA”) and the Children’s Online Privacy Protection Act of 1998 (15 U.S.C. §§ 6501-6506) (“COPPA”), or as authorized by the parent/student.

When you post or comment, other users of the Service may be able to view your content. However, you can assign viewing and usage privileges to other users.

YOU ARE SOLELY RESPONSIBLE FOR THE CONTENT THAT YOU POST INCLUDING PERSONALLY IDENTIFIABLE OR PERSONAL INFORMATION. ANY INFORMATION YOU DISCLOSE VIA THE SERVICE MAY BECOME PUBLIC INFORMATION THROUGH THE ACTIONS OF ANY OTHER THIRD PARTY USER.

We may automatically collect non-personal information for quality and performance purposes. We collect non-personal data to improve quality and performance in the following ways: to improve the Service appearance, to provide personalization of the Service for users and to measure the performance of communications. The technologies we may use to collect this non-personal information may include IP addresses, web browser cookies, clear gifs, browser detection, and metadata.

3) How We Use Information

We collect Personal Information from you so that you may have secure access to the Service. You are responsible for safeguarding your own username, password, and email address. In the event that your account information has been breached, please notify us immediately.

We may contract with third party vendors to provide us services such as website and data hosting, software, customer communications, analytics or evaluation of the information we collect. We may provide your Personal Information to these third parties in order for them to conduct those services. Each third party will be prohibited by contract from using your information for any other purpose.

WE WILL NOT KNOWINGLY COLLECT ANY PERSONAL INFORMATION FROM CHILDREN UNDER THE AGE OF 13 WITHOUT CONSENT. IF WE COLLECT INFORMATION OF STUDENT USERS, YOU OR THE ADMINISTRATOR RESPONSIBLE FOR SUCH STUDENT’S USE OF THE SERVICE MAY, AT ANY TIME, REQUEST THAT WE DELETE ALL STUDENT’S INFORMATION. EXCEPT AS NECESSARY TO PROVIDE THE SERVICE OR AS OTHERWISE SET FORTH IN THIS PRIVACY POLICY, WE SHALL NOT SHARE, DISCLOSE, OR OTHERWISE USE SUCH PERSONAL INFORMATION FOR ANY PURPOSE.  OUR USE OF PERSONAL INFORMATION REGARDING  STUDENTS SHALL BE IN CONJUNCTION WITH APPLICABLE STATE AND FEDERAL LAW, INLCUDING FERPA AND COPPA.

4) Our Commitment to Data Security

Access to your Personal Information and all data you store on the Service is limited to authorized DataHouse staff and authorized service providers. We protect data by encrypting web Service traffic via modern TLS (“https”) protocols, implementing password protection safeguards and engaging firewall technologies to prevent unauthorized access to our servers.

In the event of an unauthorized disclosure of Personal Information, we will promptly notify you of such disclosure as required by applicable state and/or federal law.

5) Use by Children

ONLY PERSONS OVER THE AGE OF EIGHTEEN may register and create accounts with administrative privileges. Only accounts with administrative privileges may grant children access to the Service. NO UNSUPERVISED CHILDREN MAY USE THE SERVICE AT ANY TIME.

THE ADULT REGISTERING A “CLASS” AND CREATING AND/OR ADDING STUDENT-USERS TO THE ACCOUNT IS RESPONSIBLE FOR (1) OBTAINING PERMISSION OF A PARENT OR GUARDIAN OF ANY STUDENT-USERS UNDER THE AGE OF 13 WHO USE THE SERVICE; AND (2) ENSURING THAT THEIR USE OF THE SERVICE IS IN COMPLIANCE WITH SCHOOL GUIDELINES AND/OR STATE OR FEDERAL LAWS AND REGULATIONS INCLUDING FERPA AND COPPA.

6) Legal Disclaimer

We reserve the right to disclose your Personal Information as required by law such as, to comply with a judicial proceeding, court order, or legal process.

This Privacy Policy only applies to information collected by us via the Service. The Service may contain links to other websites. We are not responsible for the privacy practices of any other websites. You must read and agree to the privacy statements of each website that collects your Personal Information.
